Ordinance 06-2023 — Updated ADU Regulations (Effective Aug 11, 2023)
The Fremont City Council adopted Ordinance 06-2023 on July 11, 2023, updating ADU regulations under Fremont Municipal Code 18.190.005. ADUs are permitted on both single-family and multi-family properties. Junior ADUs (JADUs) of up to 500 sq ft may be created within existing single-family residences. Each ADU requires a standalone permit application — combined applications with primary residence work will be rejected. The ADU Amnesty Program (AB 2533) remains open for owners with unpermitted units seeking compliance.

Accessory Dwelling Units — What Homeowners Need to Know
An ADU is a residential unit located on the same parcel as a primary home. It can be attached to the main residence or built as a detached structure. ADUs must provide complete, independent living facilities, including living and sleeping areas, a kitchen, bathroom facilities, and permanent provisions for cooking, eating, and sanitation.
ADUs are permitted on both single-family and multi-family properties, subject to City regulations under Fremont Municipal Code 18.190.005.
Smaller Units, Simpler Permitting — Junior ADUs Explained
The City of Fremont also allows Junior ADUs (JADUs) — smaller units that are no more than 500 square feet and fully contained within an existing single-family residence, including an attached garage.
JADUs include an efficiency kitchen with cooking appliances, food prep counter, and storage cabinets. They may have a separate bathroom or share one with the main residence.
Every ADU Needs Its Own Standalone Permit
One of the most important things to understand: an ADU requires its own separate permit. Even if the ADU is attached to the primary residence — and even if you're remodelling the main home at the same time — you must submit one permit application for the primary residence work and a separate, standalone permit application for the ADU.

ADU Amnesty Program — AB 2533
The City of Fremont complies with California Assembly Bill (AB) 2533 by offering an ADU Amnesty Program. This program provides property owners additional time to bring unpermitted ADUs into compliance with building codes.
